Breath sample refusal leads to arrest in Guelph

On Wednesday morning, the Guelph Police Service received reports about a car swerving in and out of oncoming lanes. Police added the man was seen by a witness driving on the shoulder. While also waving his hands and arms outside his window in the Wellington St W and Edinburgh Rd S area.
In a media release Officials say they were able to find the vehicle, parked poorly in a plaza on Wellington St and Gordon St.
When police approached the vehicle, they say the driver had fallen asleep.
After talking with the driver, a 21-year-old man from Guelph, officers noticed a smell of alcohol coming off the man.
Police say the man was having difficulties staying balanced, then declining to give police a breath sample. Despite police informing the driver that refusal was a criminal offence, the Guelph man still declined.
The 21-year-old man from Guelph is now facing charges of refusing to comply with a breath demand. The driver’s license was suspended for 90 days, and his vehicle was impounded for seven days.
The Guelph Police Service would like to encourage the public to be responsible if they choose to consume alcohol and cannabis. Please don’t drive if you are going to consume alcohol or cannabis, and please ensure that you plan ahead so that you have a safe ride home. Anyone who spots a suspected impaired driver is asked to immediately call 911.
