Family custody after luring charge

A Cambridge man is in the custody of a family member today after being charged over allegations of sending sexually explicit messages to boys via Facebook.
A publication ban protects the identity of the accused and the two boys named during a pretrial proceeding in the provincial courthouse in Kitchener yesterday.
But police say the accused is a 48-year-old man, charged with two counts of invitation to sexual touching, and luring a child via computer.
In outlining the evidence, the Crown prosecutor stated one of the boy’s mother found the message on her son’s Facebook account, but added, the boy himself told police no sexual contact had happened.
The accused was released into the custody of his brother, who swore to the court to act as a surety while the accused stays at his Cambridge house during legal procedings.
The conditions of the release state it is the brother’s responsibility now to keep the accused away from anyone under the age of 18, and away from any place such youths could reasonably be expected to frequent, including schools and swimming pools.
Also, the brother must keep the accused from accessing any device with internet capabilities — that includes packing up the home computer.
The brother also has the responsibility of notifying police immediately should the accused break any condition of the surety — he can even call police and have the accused taken back into custody simply if he doesn’t want to be the surety anymore.
The brother will also have to pay a fine of $2,500 dollars should the accused violate any of the conditions of his release.
