A homicide case in Kitchener is in a state of legal limbo, as the Crown tries to decide if the best charge to lay is first-degree or second-degree murder.
Crown Attorney, Mark Poland tells 570 NEWS, the case of a man accused of killing his brother in a fight on Mooregate Crescent last week may be changed over to the lesser charge, even though the original charge was first-degree.
Poland says his office needs to have a meeting with investigators from Regional Police to decide the best way to prosecute 43-year-old Mohamed Younus.
He expects they’ll have that meeting within the next two weeks.
Poland says the case is still in its early days, but everything will be sorted out.
He says while anything is possible, he does not believe the end result will be anything less than a murder charge.
Younus was arrested after police investigated a fight at a home on Mooregate from August 27 that they say resulted in the stabbing death of a 37-year old man.
Younus makes his next court appearance on September 28.
