We could call this the case of the tell-tale doggy-doo.
The Ontario Court of Appeal has upheld a theft conviction against a Kitchener woman, saying a police officer did not breach her charter rights by sniffing her shoes.
Surriff Atkinson found herself in deep doo-doo when she stepped in feces from an untrained puppy before stealing a T-V from a living room in 2009.
The officer — who noticed doggy-doo all over the crime scene — later went to Atkinson’s home and spotted shoes with something stuck to the soles.
The shoes did not pass the sniff test — evidence that was central to convicting Atkinson for the burglary.
